Operating Rules

The Melbourne Market Operating Rules ensure the Market remains a safe place for people to visit, work and trade. It is your responsibility to understand and follow these rules, which are enforced through a demerit points system connected to each employer.
Whatever your role, you have a legal duty of care to work in a manner that is not harmful to your health, safety and environment - and/or the health of others, which includes behaving in an orderly manner and keeping the Market a clean workplace.

15. Limitation of liability

    15. Limitation of liability

    (a) To the extent permitted by law, the MMA and any MMA Associate or Authorised Representative are not liable for anything they may or omit to do or for any loss of damage to any Vehicle, property or goods, or death or injury to any Person however caused.

    (b) Any covenant, warranty or obligation of the MMA which is implied by legislation or the common law is excluded to the extent permitted by law. To the extent that the MMA cannot exclude the operation of any covenant, warranty or obligation which is implied by legislation or the common law, the MMA will be liable only for any loss or damage to any Vehicle, property, goods, or death or injury to any Person to the extent that the MMA has breached that implied covenant, warranty or obligation, but is then
